Introduction

SHAZAM, Inc. (“SHAZAM,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy (“Policy”) describes the information (as defined below) that we may collect from you or that you may provide when you visit websites published by SHAZAM (“Websites”), as well as our practices for collecting, using, maintaining, protecting and disclosing that Information.

Please read this Policy carefully to understand our practices. By accessing or using our Websites, you understand that your information, (including your personal information, as defined below) will be managed as described in this Policy, and that any dispute over privacy resulting from your use of our Websites is subject to this Policy. If you do not agree with our practices, your choice is to not use our Websites.

This Policy may change from time to time. Your continued use of our Websites after we make changes is your acceptance of those changes. Review the Policy regularly for updates.

The information we collect through our Websites is controlled by SHAZAM, Inc., which is headquartered in the United States at 6700 Pioneer Parkway, Johnston, IA 50131. Questions about this Policy or any other privacy concern may be directed to Legalteam@shazam.net.


Children under 16

Our Websites are intended for general audiences and are not directed at minors. If we discover that a child under the age of 16 (or such other appliable age of consent for privacy purposes in relevant individual jurisdictions) has provided us with information, we will delete such information from our systems. If there is any data that we are unable, for technical reasons, to delete entirely from our systems, we will implement appropriate measures to prevent any use of such data.


Applicability of this Policy

This Policy applies to:

  • Information we collect through our Websites.
  • Information we collect in email, text or other electronic messages that provide dedicated, non-browser-based interaction between you and our Websites.
  • Information we collect through authorized SHAZAM advertising and content placed on third-party websites that correctly include links to our Websites and/or this Policy.

This Policy does not apply to:

  • Information we collect from our personnel, including employees or contractors.
  • Information we collect offline or through any means other than those associated with the Websites and as listed above.
  • Information collected by any third party, including third parties that may link to or be accessible from or on our Websites, or through any third-party application or content (including advertising) that may link to or be accessible from or on our Websites.

SHAZAM may maintain pages for our company, products and services on third-party platforms, including social networking services. If you interact with us on those third-party platforms, the third party’s privacy policy will govern. If the third-party platform provides us with information about your interaction with our content or your interactions with the third-party platform, we will treat that information in accordance with this Policy.


The information we collect about you

We collect and process several types of information from and about users of our Websites, including the following:

  • Information that may personally identify you. This may include your name, address, email address, telephone number or any other identifier by which you may be contacted online or offline (“personal information”).
  • Information that is not associated with you and cannot be used to identify you as an individual. This is information that cannot be tied to you on a personal basis and may include details such as operating system, browser type, general location, referring website or traffic source, and usage information.
  • Feedback and correspondence. This includes information you provide when you request information, receive customer support or otherwise correspond with us.
  • Information collected by automated means about you, your device and your activity on our Websites. This may include details such as your operating system, browser type, IP address, general location, usage information, length of access and navigation paths between pages.
  • Any other information you may provide to us through our Websites.

Retention of information

We may retain your Information for a period of time consistent with the original purpose of collecting it (as described in "How We Use Your Information" below), or for as long as required to fulfill our legal obligations. We determine the appropriate retention period for information (including personal information) on the basis of the amount, nature and sensitivity of the data, the potential risk of harm from unauthorized use or disclosure of the data, whether we can achieve the purposes of the processing through other means, and on the basis of applicable legal requirements (such as applicable statutes of limitation).

We will delete or de-identify personal information when it is no longer needed to fulfill the original purpose of collection unless a longer retention period is required to comply with applicable laws.


How we collect your information

We collect information about you directly from you and from third parties, as well as automatically through your use of our Websites.

Information we collect directly from you

If you contact us or access gated content, such as whitepapers or other downloads, through our Websites, we may ask you to provide information including your name, business name, job title, business contact information (such as your business address, phone number and email address) and your reason for contacting us.

Information we collect automatically

As you navigate through our Websites, we may use cookies or other tracking technologies to collect information including your domain name, your browser type and operating system, web pages you view, links you click, your IP address, the length of time you visit our Websites, the actions you take on our Websites, and the referring URL, or webpage, that led you to our Websites.

This information may be combined with other information we have collected about you, including, where applicable, your name and other personal information, to help us improve our Websites and deliver a better and more personalized service to you.

The following technologies may be used for automated data collection:

Cookies:

 We and our third-party service providers set and use cookies and similar technologies to store and manage user preferences, enable content, gather analytic and usage data, and deliver targeted advertising. Cookies are alphanumeric identifiers that are transferred to your device's hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Websites, while others are used to allow us to track your activities on our Websites. You can refuse to accept browser cookies by activating the appropriate setting in your browser. Cookies are typically assigned to one of the following categories, depending on their function and intended purpose:

  • Essential cookies enable you to navigate our Websites and to use our services and features. Without these cookies, our Websites will not perform as smoothly for you as we would like, and we may not be able to provide certain core functions and features.
  • Analytics cookies collect information about the use of our Websites and enable us to improve the way they work. For example, analytics cookies show us the most frequently visited pages and analyze site traffic. We use them to look at overall patterns of usage on the Websites, rather than the usage of any particular individual.
  • Social media cookies collect information about your visit to our Websites, but only when you are logged in to your social media account.
  • Customer interaction cookies allow us to communicate with you, including real-time communication through chat features.
  • Marketing cookies track browsing habits and are used to deliver targeted (interest-based) advertising.
You can opt out of receiving targeted ads for web properties by visitinghttps://optout.aboutads.info/.   Most browsers are set up to accept cookies automatically. You can deactivate the storing of cookies or adjust your browser to inform you before a cookie is stored on your device. Some browsers have “do not track” features that allow you to tell a website not to track you. These features are not all uniform. SHAZAM does not currently respond to those signals.

Web beacons:

Web beacons (also known as clear gifs, pixel tags and single-pixel gifs) are tiny graphics with a unique identifier, similar in function to cookies. Unlike cookies, which are stored on your hard drive, web beacons are embedded invisibly on web pages. We use them to track the activities of visitors to our Websites, help manage content, compile statistics and verify system and server integrity.

If you disable or refuse automated technologies, some parts of our Websites may be inaccessible to you or may not function properly.

Information we collect from third parties

We may collect information about you from third-party websites or social media platforms that provide us with information about your interaction with our content on that website or platform, depending on the third-party’s data practices and your settings. Any such information collected from third-party websites or social media platforms will be managed as described in this Policy.

Any comments, or other content publicly shared with other users on any third-party websites or social media platforms, is not confidential, and we reserve the right to use it for any purpose (including in testimonials or other marketing materials).

We may also collect information that is already in de-identified form (i.e., usage analytics data) from such third-party websites or social media platforms. Our use and disclosure of de-identified Information is not subject to any restrictions under this Policy, and we may use and disclose it to others for any purpose, without limitation.

SHAZAM is not responsible for the content or practices of third-party websites or social media platforms. We urge you to read the privacy and security policies of any third-party website or social media platform you use and contact the third-party provider directly if you have questions or concerns.


How we use your information

We use your Information, including your personal information, for the following purposes:

  • To personalize your experience while using our Websites. This may include tailoring the content and information we display to you, pre-filling forms or offering personalized help and instructions.
  • For marketing and promotional purposes in accordance with applicable law. We may use your Information, such as your email address, to send you newsletters, special offers and promotions, or to contact you about products, events or information we think may interest you. We also use the information that we learn about you to assist us in advertising our services on third-party websites and platforms.
  • To better understand how users access and use our Websites. Information we collect, both on an aggregated and individualized basis, may be used to improve our Websites, respond to user preferences or for other research and analytical purposes, such as evaluating product demand by market.
  • To conduct our business obligations and enforce our rights arising from any contracts between you and SHAZAM. This may include providing you with transactional notices about your account, notifying you about changes to our Websites, informing you about updates to products and services, responding to your inquiries, or any other activity we describe when asking you to provide information.
  • For legal purposes. We also use the information we collect, when necessary, to identify and protect against fraud and other illegal activity, to comply with law or a legal obligation to which we are subject, or to exercise or defend legal claims.
  • For any other purpose with your express consent.

How we disclose your information

SHAZAM will never disclose or divulge non-public personal information about any consumer to nonaffiliated third parties in connection with any financial product or service we provide to consumers and their customers.

(For the purposes of the above paragraph, the definitions of "non-public personal information," "nonaffiliated third parties," "consumers," "customers," and "financial products or services" are as set forth in applicable federal and/or state laws and/or regulations, including Section 504 of the Gramm-Leach-Bliley Act, Pub. L. 106-102, and any amendments thereto.)

Your information, including your personal information, may be disclosed under the following circumstances:

Disclosure necessary to transactions

As a service provider, SHAZAM is authorized to disclose non-public personal information about a consumer performing EFT transactions to other parties that are necessarily involved with the transaction. The exchange of such information is necessary and appropriate in connection with the financial product or service being supported by SHAZAM. Pursuant to certain federal regulatory exceptions, there is no prohibition on the disclosure of such information by a financial institution, or by SHAZAM to another involved party to the EFT transaction, as necessary to perform transaction processing on behalf of the consumer. There is also no prohibition on the disclosure of such consumer information that is appropriate or necessary in connection with the authorization, settlement, processing or reconciliation of amounts that may be charged, debited or otherwise paid using a transaction card.

SHAZAM may disclose such non-public information (including personal information) to the following:

  • Each participant or agent of a participant that is a necessary party to the completion of the transaction.
  • Any other person or entity that is a party to the transaction or is necessary to the completion of the transaction.
  • Any regulatory authority with jurisdiction over financial institutions, processors or SHAZAM in response to a written request.
  • Any third-party auditor of the SHAZAM network if a compelling need to examine such transactions is demonstrated by the auditor. 

Disclosure of business statistics

SHAZAM will not divulge statistics about the business operations of any SHAZAM network participant to any third party without written consent. SHAZAM may compile and disclose, without limitation, total terminal statistics that are generic to the network and do not contain specific information identifying individual users or information concerning the operations of any user.

Disclosure for legal business functions

SHAZAM may employ third-party companies and individuals to administer and provide services on our behalf. These third-party vendors may have access to and use your information for the purposes outlined in "How We Use Your Information," but only as directed by SHAZAM and in a manner consistent with this Policy and as required by applicable privacy laws.

Disclosure for marketing activities

We may share testimonials or images from events, which may include using your information in physical or digital media channels, as part of our marketing and promotional activities. If we disclose your information to a third party for any type of marketing or advertising research activity, it will only be shared in aggregate or de-identified form.

Compliance with laws and law enforcement

SHAZAM will disclose information about you to government or law enforcement officials or private parties as required to comply with applicable laws, lawful requests and legal proceedings. We may also disclose any information collected from you that we believe is necessary or appropriate to enforce the terms and conditions that govern our products and services; prevent or deter potential threats to our property or safety, or that of any other person; or to investigate and take action against fraudulent, harmful, unauthorized, unethical or illegal activity. Information may also be disclosed in connection with violations of any terms of service or this Policy, or as evidence in litigation in which SHAZAM is involved.

Business transfers

SHAZAM may sell or transfer some or all of its business or assets, including your information, in connection with a business transaction (or potential business transaction) such as a merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy, in which case we will make reasonable efforts to require the recipient to honor this Policy.


Data security

SHAZAM has implemented appropriate security measures to prevent your personal information from accidental loss, unauthorized access, misuse, alteration and/or disclosure. In addition, all personal information that you provide to us is stored on secure servers behind firewalls, with access limited to employees, agents and contractors who have a business need to know. We also maintain annual compliance with global Payment Card Industry Data Security Standard (PCI DSS) adopted by the payment card brands for all companies that process, store or transmit cardholder data.

Please be aware that, despite our efforts, no data security measures can guarantee security. Any transmission of personal information to our Websites is provided at your own risk. Although we are not responsible for circumvention of any privacy and security measures, we have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Third-party links

Our Websites may contain links to third-party websites, mobile applications or other content for your information or convenience. Any access to and use of such links is not governed by this Policy but instead is governed by the privacy policies of those third-party websites. SHAZAM assumes no responsibility for the privacy practices or content of any third- party website, mobile application or content.


Your rights regarding your personal information

Depending upon the jurisdiction in which you reside and subject to certain exceptions, you may have certain rights regarding the personal information we collect about you or that you provide. If you live in one of the states listed below, you may have the following rights:

Right to access, correct or delete

You have the right to request access to the personal information that we hold about you; the right to request that we correct any of your information, if you believe it is incorrect, incomplete or inaccurate; and the right to request that we delete your information. We may not be able to meet your request to access, correct or delete your personal information in all circumstances.

  • In Indiana, the right to correct your personal information is limited to personal information you provided to us and does not include personal information collected from other sources.
  • In Iowa, the right to correct data is not applicable.
  • In Utah, the right to delete your personal information is limited to personal information you provided to us and does not include personal information collected from other sources.

Right to data portability

 You have the right to receive a copy of your personal information in a commonly used, machine-readable and readily usable format. You may direct us to send this copy to you or another party you designate.

  • In Delaware, Indiana, Iowa, Montana, Nebraska, Tennessee, Texas, Utah and Virginia, the right of data portability is limited to personal information you provided to us and does not include personal information collected from other sources.

Right to refuse

You have the right to refuse to provide your personal information through our Websites whenever we request it directly from you. If you decide not to provide the requested information, some parts of our Websites may be inaccessible to you or may not function properly.

Right to disable tracking technologies

You have the right to disable our tracking technologies by setting your browser to refuse all or some browser cookies. If you disable or refuse cookies, some parts of our Websites may be inaccessible to you or not function properly.

Right to opt out of marketing and promotional offers

You have the right to opt out of marketing and promotional offers by checking the relevant box on the form on which we collect your data or by selecting the link in a marketing message to manage your subscription preferences. If you opt out of receiving marketing and promotional offers, we will continue to conduct other relevant activities using your information, including sending service-related and other non-marketing messages.

  • In Iowa, the right to opt out of marketing and promotional offers is not applicable.

Right to opt out of targeted online advertising

You have the right to opt out of sharing your personal information for online targeted advertising purposes. Some of the business partners that collect information about users’ activities on our Websites may be members of organizations or programs that provide choices to individuals regarding the use of their browsing behavior for purposes of targeted advertising.

  • In Iowa, the right to opt out of targeted online advertising is not applicable.

Right to opt out of the sale of your personal information

You have the right to opt out of the sale of your personal information to third parties.

Right to lodge a complaint

You have the right to lodge a complaint about our handling of your personal information. Please provide details about your concern or complaint so that we can investigate it promptly and take appropriate action. We may contact you for additional details or clarification about your concern or complaint or to confirm your identity for security purposes. We will notify you of the results of our investigation; however, we may not always be able to fully address your request due to confidentiality and legal requirements.

Shine the Light

California's "Shine the Light" law (Civil Code Section §1798.83) permits California residents who have an established business relationship with us to request certain information regarding our disclosure of certain types of personal information to third parties for their direct marketing purposes during the immediately preceding calendar year.


Exercising your rights

To exercise these rights, contact us at Legalteam@shazam.net. Once we receive a request to exercise your data privacy rights, we may be required to verify your identity before proceeding. We verify identities by comparing certain details you provide (such as name, email and relationship) with information we have. In some cases, we need additional details to verify your identity. In certain circumstances, we may decline a request to exercise the rights above, particularly where we are unable to verify your identity or locate your information in our systems, or as otherwise permitted by law.

We will not discriminate against you for exercising the above rights. However, please note that if the exercise of these rights limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide our products and services to you or engage with you in the same manner.
